1. Agreement to Terms
Welcome to Makaan Mitra. These Terms of Service ("Terms") constitute a legally binding agreement between you and Makaan Mitra regarding your access to and use of our website, mobile application, and property management ecosystem. By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. User Eligibility & Accounts
Access to Makaan Mitra is restricted to individuals at least 18 years of age. Users are responsible for maintaining the confidentiality of their credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend accounts that provide false or misleading information during the KYC process.
3. Scope of Services
Makaan Mitra provides a digital platform for property management, including but not limited to tenant onboarding, digital rent collection, maintenance request tracking, and staff management. We act as a facilitator and platform provider, not as a real estate broker or legal advisor.
4. Property Owner Responsibilities
As a Property Owner (Host/Manager), you represent and warrant that:
- You have the legal right to list and manage the properties registered on the platform.
- All property details, room configurations, and amenities listed are accurate and up-to-date.
- You will comply with all local rental laws, tax regulations, and data privacy requirements.
5. Tenant Conduct & Obligations
Tenants using the Makaan Mitra portal agree to use the services for lawful purposes only. Prohibited conduct includes but is not limited to: uploading malicious software, attempting to bypass billing systems, providing fraudulent documentation, or harassing other users or staff via the platform communication channels.
6. Financial Terms & Subscriptions
Billing Cycles
Subscriptions are billed in advance on a recurring monthly or annual basis. Failure to renew may result in restricted access to premium dashboard features.
Refund Policy
Unless required by law, subscription fees are non-refundable. Users can cancel their subscription at any time, but will retain access until the end of the current billing period.
7. Intellectual Property
All content, features, and functionality (including logo, code, and design) are the exclusive property of Makaan Mitra. You are granted a limited, non-exclusive license to use the platform for its intended property management purposes. Any unauthorized reproduction or distribution is strictly prohibited.
8. Termination
We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Makaan Mitra shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the platform, including disputes between owners and tenants.
